This Privacy Notice sets out how the personal data (hereinafter referred to as “Data”) you have provided through this website, which has been collected by Chpconsult (“we” or “us”), will be processed according to the applicable laws and regulations. We are committed to protecting and respecting your privacy.

1. HOW DO WE COLLECT YOUR DATA ?

We can collect, process and store the following Data:

  • The Data you provided in order to receive a specific service or as part of our business relationship (such as your contact detail, professional data, financial or technical information)
  • Data pertaining to your browsing on our website or Data resulting from your interaction with our website
  • Cookies

This Data is usually collected directly from you, but we may, in certain instances, collect some Data concerning you from a third party or public documents. In such cases, we protect the Data collected from this third party in accordance with the practices described in this Privacy Notice.

2. HOW DO WE USE YOUR DATA ?

We can process the Data we collect for the following purposes:

  1. To answer all of your questions by providing you with information regarding our products, services, offers or sales network
  2. To establish, maintain and develop our relationship
  3. Subject to obtaining your consent, to allow us to send you newsletters, business communications and adverts on our products and services or to carry out market research. All of these operations may be carried out on printed documents or through automated or electronic processing, including post or email, telephone (for instance: automated phone calls, text or picture messages, fax) and any other means (for instance: websites, mobile apps): “MARKETING ACTIVITIES”
  4. Subject to obtaining your consent, to allow us to communicate your data to companies affiliated with Chpconsult and to our partners. These partners will process your data in order to send you their marketing communications as well as advertisements for their products and services or to conduct market research: “THIRD-PARTY MARKETING”

The lawfulness of the processing operations referred to in points (i) and (ii) above is based on the legal bases pertaining to the performance of the contract and the pursuit of our legitimate interests, and the ones referred to in points (iii) and (iv) above on the consent you have given us. In this regard, we inform you that you are free to withdraw at any time the consent you have given us. Your Data can be processed electronically in our computer systems or manually, on paper. Your Data will be processed in a lawful, fair and transparent way and stored for its whole life cycle, ensuring its security and confidentiality in accordance with the provisions of applicable laws and regulations.

3. CONSEQUENCES OF FAILURE TO PROVIDE YOUR DATA

Submitting your Data is never mandatory. However, if you fail to provide Data that is necessary to provide a service or a product, we may not be able to guarantee the provision of the required service or product or the quality of the above-mentioned provision. On the other hand, not providing Data marked as optional will allow you, in any event, to access the service or to receive the product.

4. HOW DO WE SHARE YOUR DATA ?

We provide communication and marketing solutions. Your Data may be shared with and disclosed to trusted third parties and to our partners, service providers, trading partners, based in and outside the European Union, insofar as they are subject to appropriate contractual obligations and may use your Data solely for the purposes mentioned above.

Your Data may also be disclosed to third parties when required by law, to ensure and preserve our safety and the safety of Chpconsult, to protect our rights or interests or the rights and interests of Chpconsult, to comply with any injunctions from public authorities or to exercise our rights before judicial authorities.

5. HOW WE TRANSFER YOUR DATA

In order to process some Data processing operations as detailed above, we may transfer your Data to countries outside of the European Economic Area (EEA), including the storage of such Data in digital or physical databases managed by companies acting on our behalf.  Database management and Data processing are limited to the sole purposes of the processing and are carried out in accordance with applicable data protection laws and regulations.

If your Data is transferred outside of the EEA, we will use any appropriate contractual measures to ensure that your Data is adequately protected, including agreements based on standard contractual clauses on data protection adopted by the European Commission, applicable to the transfer of personal data outside the EEA.

6. RETAINING YOUR DATA

We only retain your Data in our systems and archives for as long as necessary to fulfil the purposes described in this Privacy Notice, taking into account, when applicable, legal and contractual requirements.

When your Data is no longer necessary to fulfil the purposes we collected it for, it is deleted or stored in a form that no longer allows your identification, provided that we are not legally required or permitted to retain such Data. We may continue to store Data for a longer period, if this proved necessary in the event that our liability for the provision of services or products or for the processing of the Data is challenged. Data processed for marketing and profiling purposes will be retained until you withdraw your consent and, in any event, in accordance with the above-mentioned principles and the guidelines provided by the relevant Personal Data Protection Authorities.

8. YOUR RIGHTS REGARDING YOUR DATA

You may exercise your rights as defined by applicable laws and regulations, including:

  • Right of access: you have the right to obtain from the Data Controller confirmation as to whether or not your Data is being processed and, if so, to request an access to your Data.
  • Right to rectification: you have the right to obtain from the Data Controller the rectification of any Data you believe is inaccurate or incomplete, including by providing a supplementary statement.
  • Right to erasure: you have the right to obtain from the Data Controller the erasure of your Data without undue delay, when the request is made in accordance with the applicable laws and regulations.
  • Right to object: you have the right to object at any time to the processing of your Data unless the Data Controller demonstrates compelling legitimate grounds overriding this right.
  • Right to restriction of processing: you have the right to obtain from the Data Controller restriction of the processing activities where the accuracy and precision of Data is contested, for a period enabling the Data Controller to verify the accuracy of the Data.
  • Right to data portability: you have the right to receive the Data you provided to the Data Controller in a structured, commonly used and machine-readable format.  You also have the right to transmit this Data to another Data Controller without hindrance from us where the processing is based on consent or on a contract and carried out by automated means.
  • Right to lodge a complaint: without prejudice to any other administrative or judicial remedy, if you consider that the processing of your Data has been carried out illicitly or is not compliant with applicable laws and regulations, you have the right to lodge a complaint before the Supervisory Authority of the Member State of your habitual residence or place of work, or of the Member State where the alleged infringement has taken place.

Should you send us a request, we reserve the right to request additional information from you to allows us to verify your identity and contact you, if necessary.  This information, together with other Data we already withhold, will then be processed in order to meet your request, as required by applicable law. Where necessary, some information may be transferred to other external data processing companies in order to meet your request. Your Data will be processed for the necessary amount of time to evaluate and manage your request, after which your Data will be stored for a suitable period of time, allowing us to demonstrate that the request has been processed correctly and in a timely manner.

9. UPDATES TO THIS PRIVACY NOTICE

This Privacy Notice was updated in May 2018. We reserve the right to amend or update regularly this Privacy Notice to reflect changing legal requirements or the evolution of our processing activities.  We will publish any updates on this website and it will be effective upon posting. We encourage you to periodically review this Privacy Notice to learn how we process your Data.
